Permit to Perform Breath Alcohol Analysis

Obtain an initial permit to perform breath alcohol analysis

In order to obtain a permit to perform breath alcohol analysis, one must complete an approved training program.

An approved training program consists of:

  • 24 hours of instruction
  • training on instruments
  • formal examination
  • demonstration of proficiency
  • is supervised by a certified technical supervisor

Breath alcohol analysis permits are valid for two years.

Recertify your breath alcohol analysis permit

Recertification cannot be more than 120 days (~4 months) prior to the permit expiration date.

Attend a recertification class:

  1. An instructional course in breath analysis
  2. Demonstrate analytical proficiency on each breath analysis instrument for which you seek renewal
  3. Attain a passing score on a formal examination

Questions regarding on-line breath alcohol operator permit recertification should be directed to New York State Division of Criminal Justice Services. Please contact DCJS staff for assistance at OPS.Traffic@dcjs.ny.gov or (518) 457-2666.

Alternate recertification

The operator and supervisor submit to the training agency, a written declaration that the operator has performed six or more breath analyses on each breath analysis instrument for which the operator is seeking permit renewal during the 24 months preceding permit expiration.

Every four years all operators must participate in the re-training course (the alternate recertification method can only be used once and then you must take an instructional course to recertify.)

Failure to recertify

Breath alcohol permitted operators who do not recertify within the allotted time frame (2 years) may be given a 30 day grace period extending the expiration date of the permit.

  • An extension requires a written request by the training agency and operator.
  • After the 30 day grace period, no further extension is allowed and the operator must attend a 24 hour certification course to reapply for a permit.

The effective date of the permit will be the new date of approval after completion of the course.
